TERMS AND CONDITIONS 

King of the Court Australia

PREAMBLE 

King of the Court Australia, accessible at ….. www.kingofthecourt.org, is a wholly owned entity of Bill Lang International ("BLI"), a business education, coaching, and advisory organisation based in Melbourne, Victoria, Australia. 

All intellectual property rights, including but not limited to trademarks, logos, brand names, designs, and content associated with King of the Court activities and the Website, are ultimately owned by and protected under the terms and conditions that apply to Bill Lang International. 

These Terms and Conditions ("Terms") govern your use of the King of the Court website and your participation in any events, competitions, or activities organised or promoted by King of the Court ("KOTC Activities"). By accessing or using this Website or participating in KOTC Activities, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS 

By accessing, browsing, or using the Website, or by registering for, attending, or participating in any KOTC Activities, you ("User", "you", or "your") agree to comply with and be legally bound by these Terms and all applicable laws and regulations. 

If you do not agree with any part of these Terms, you must immediately cease using the Website and must not participate in any KOTC Activities. 

These Terms constitute a binding legal agreement between you and King of the Court Australia (a wholly owned entity of Bill Lang International). 

 

2. DEFINITIONS 

For the purposes of these Terms: 

  • "KOTC Activities" means any streetball tournaments, basketball events, trade promotions, competitions, training sessions, social events, or related activities organised, hosted, promoted, or facilitated by King of the Court Australia including TripleswishTM. 

  • "Participant" means any individual who registers for, attends, or takes part in KOTC Activities, whether as a player, spectator, volunteer, or otherwise. 

  • "Content" means all text, images, graphics, logos, videos, audio, data, software, and other materials available on the Website. 

  • "Personal Injury" means death, physical or mental injury (including the aggravation, acceleration, or recurrence of such injury), the contraction, aggravation, or acceleration of a disease, or any other harmful condition. 

  • "Reckless Conduct" means conduct where the supplier is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person, and engages in the conduct despite the risk and without adequate justification. 

 

3. RULES OF USE FOR THE WEBSITE 

3.1 Licence to Use 

King of the Court Australia grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes, subject to these Terms. 

3.2 Prohibited Uses 

You agree not to: 

  • Use the Website for any unlawful purpose or in violation of these Terms or any applicable laws or regulations. 

  • Attempt to gain unauthorised access to any part of the Website, other users' accounts, or any computer systems or networks connected to the Website. 

  • Introduce or upload viruses, malware, or any other malicious code. 

  • Use any automated means (including bots, scrapers, or robots) to access, monitor, or copy any Content without express written permission. 

  • Interfere with or disrupt the operation of the Website or servers or networks connected to the Website. 

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity. 

  • Post, transmit, or share any content that is defamatory, obscene, offensive, discriminatory, threatening, harassing, or otherwise inappropriate. 

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website without express written permission. 

3.3 User Accounts 

If the Website requires you to create an account, you must: 

  • Provide accurate, current, and complete information during registration. 

  • Maintain and promptly update your account information. 

  • Maintain the security and confidentiality of your account credentials. 

  • Notify us immediately of any unauthorised use of your account. 

You are responsible for all activities that occur under your account. 

3.4 Termination of Access 

King of the Court Australia reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Website at any time, without notice or liability, for any reason, including but not limited to breach of these Terms. 

 

4. INTELLECTUAL PROPERTY OWNERSHIP 

4.1 Ownership 

All Content on the Website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, design, and the "King of the Court" name, logo, and all related trademarks including TripleSwish TM, service marks, and trade names, are the exclusive property of Bill Lang International and King of the Court Australia or its licensors. 

All intellectual property rights in the Website and its Content are owned by or licensed to Bill Lang International and are protected by Australian and international copyright, trademark, and other intellectual property laws. 

4.2 Restrictions 

You may not: 

  • Reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content without prior written consent. 

  • Use any trademarks, service marks, or logos displayed on the Website without written permission. 

  • Remove or alter any copyright, trademark, or other proprietary notices from Content. 

4.3 User-Generated Content 

If you submit, post, or upload any content to the Website (including comments, photos, videos, or feedback), you grant King of the Court Australia and Bill Lang International a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media for promotional or operational purposes. 

You represent and warrant that you own or have the necessary rights to grant this licence and that your content does not infringe any third-party rights. 

 

5. PARTICIPATION IN KOTC ACTIVITIES – NOTIFICATION OF RISKS 

5.1 Nature of Activities 

KOTC Activities involve participation in streetball basketball tournaments and related sporting activities. These activities are recreational services as defined under Section 139A of the Competition and Consumer Act 2010 (Cth) and involve: 

  • Significant physical exertion 

  • Physical contact with other participants 

  • Risk of collision, falls, and impacts 

  • Use of basketball equipment and facilities 

  • Activities undertaken for recreation, enjoyment, and leisure 

5.2 Acknowledgment of Inherent Risks 

By participating in KOTC Activities, you acknowledge and understand that participation involves inherent risks including but not limited to: 

  • Physical Injury: Sprains, strains, fractures, dislocations, cuts, bruises, concussions, and other injuries. 

  • Serious Injury or Death: In rare cases, participation may result in serious injury, permanent disability, or death. 

  • Collision and Contact: Contact with other participants, equipment, or playing surfaces. 

  • Environmental Risks: Weather conditions, outdoor playing surfaces, and venue-related hazards. 

  • Pre-existing Medical Conditions: Aggravation or worsening of pre-existing medical conditions. 

  • Equipment Failure: Risks associated with the use of sporting equipment. 

  • Psychological Impact: Stress, anxiety, or emotional distress associated with competitive activities. 

You acknowledge that these risks are an inherent and unavoidable part of participation in streetball basketball and KOTC Activities and cannot be eliminated regardless of the care taken by King of the Court Australia. 

5.3 Voluntary Assumption of Risk 

You voluntarily assume all risks associated with participation in KOTC Activities, whether known or unknown, and whether caused by the actions or negligence of King of the Court Australia, other participants, or third parties. 

You understand that participation is entirely voluntary and that you are free to choose not to participate. 

 

6. WAIVER AND RELEASE OF LIABILITY 

6.1 Release 

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless King of the Court Australia, Bill Lang International, their directors, officers, employees, agents, volunteers, sponsors, partners, and affiliates (collectively, "Released Parties") from any and all claims, demands, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in connection with: 

  • Your participation in KOTC Activities. 

  • Your use of the Website. 

  • Any Personal Injury, property damage, or other loss suffered by you. 

  • The actions or omissions of other participants or third parties. 

This release applies to claims based on negligence, breach of contract, breach of duty, or any other legal theory, except where liability cannot be excluded by law. 

6.2 Exclusion of Consumer Guarantees for Recreational Services 

Under Section 139A of the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law, King of the Court Australia is permitted to exclude, restrict, or modify the application of consumer guarantees (including the guarantee that services will be provided with due care and skill) in relation to recreational services. 

You expressly agree that: 

  • The consumer guarantees under the Australian Consumer Law (including those set out in Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) do not apply to the supply of recreational services provided by KOTC Activities. 

  • You waive your rights to make any claim against King of the Court Australia for failure to comply with those consumer guarantees. 

  • This exclusion is limited to liability for death, Personal Injury, or related harm as defined in Section 139A(3) of the Competition and Consumer Act 2010 (Cth). 

6.3 Limitations of Waiver 

This waiver and release does not apply to: 

  • Reckless Conduct: Personal Injury caused by Reckless Conduct on the part of King of the Court Australia, as defined in Section 139A(5) of the Competition and Consumer Act 2010 (Cth). 

  • Unlawful Conduct: Liability that cannot be excluded under Australian law, including liability for fraud, gross negligence, or intentional misconduct. 

  • Non-Recreational Services: Liability for services that are not part of the recreational activity itself (e.g., liability for defective venue facilities or ancillary services). 

6.4 Indemnity 

You agree to indemnify and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: 

  • Your breach of these Terms. 

  • Your violation of any law or the rights of any third party. 

  • Your participation in KOTC Activities. 

  • Any Content you submit or post on the Website. 

 

7. DISCLAIMERS 

7.1 Website Disclaimer 

The Website and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. 

King of the Court Australia does not warrant that: 

  • The Website will be uninterrupted, secure, or error-free. 

  • The Content is accurate, complete, reliable, or up-to-date. 

  • Any defects or errors will be corrected. 

  • The Website or servers are free from viruses or other harmful components. 

7.2 Third-Party Links 

The Website may contain links to third-party websites or services that are not owned or controlled by King of the Court Australia. We are not responsible for the content, privacy policies, or practices of any third-party websites. You access third-party websites at your own risk. 

7.3 Event Changes 

King of the Court Australia reserves the right to modify, postpone, reschedule, or cancel any KOTC Activities at any time due to unforeseen circumstances, including but not limited to weather conditions, venue availability, safety concerns, or insufficient registrations. We will make reasonable efforts to notify participants of changes, but we are not liable for any costs, losses, or damages incurred as a result of such changes. 

7.4 No Professional Advice 

Content on the Website is for general informational and promotional purposes only and does not constitute professional advice (legal, medical, financial, or otherwise). You should seek independent professional advice before making any decisions based on Website Content. 

 

8. LIMITATION OF LIABILITY 

8.1 Exclusion of Certain Damages 

To the maximum extent permitted by law, King of the Court Australia and the Released Parties shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with: 

  • Your use of or inability to use the Website. 

  • Your participation in KOTC Activities. 

  • Any Content or conduct of third parties on the Website. 

  • Unauthorised access to or alteration of your transmissions or data. 

8.2 Cap on Liability 

To the extent permitted by law, the total aggregate liability of King of the Court Australia and the Released Parties for any claims arising out of or related to these Terms, the Website, or KOTC Activities shall not exceed the amount paid by you (if any) to participate in the relevant KOTC Activity, or AUD $100, whichever is greater. 

8.3 Australian Consumer Law 

Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights that cannot be excluded under the Australian Consumer Law or other applicable laws. Where liability cannot be excluded, our liability is limited to the extent permitted by law. 

 

9. RULES FOR KOTC ACTIVITIES AND COMPETITIONS 

9.1 Eligibility and Registration 

Participation in KOTC Activities may be subject to eligibility requirements, including age restrictions, skill level, and registration procedures. You must provide accurate information during registration and comply with all eligibility criteria. 

9.2 Code of Conduct 

All Participants must: 

  • Treat other participants, officials, volunteers, and spectators with respect and courtesy. 

  • Refrain from abusive, threatening, discriminatory, or unsportsmanlike conduct. 

  • Comply with all event rules, safety protocols, and instructions from officials. 

  • Refrain from using drugs, alcohol, or prohibited substances during KOTC Activities. 

  • Respect the property and facilities of venues. 

9.3 Health and Fitness 

By participating in KOTC Activities, you represent and warrant that: 

  • You are in good physical health and fitness to participate. 

  • You are not aware of any medical condition that would prevent safe participation. 

  • You have consulted a medical professional if you have any concerns about your ability to participate. 

9.4 Medical Disclosure 

You agree to disclose any medical conditions, injuries, allergies, or other health concerns that may affect your participation or require medical attention. Failure to disclose relevant medical information may affect your ability to participate and may void any waiver or release. 

9.5 Medical Treatment Consent 

In the event of injury or medical emergency, you consent to receiving first aid and emergency medical treatment, including transport to a medical facility. You are responsible for all costs associated with medical treatment. 

9.6 Disqualification and Ejection 

King of the Court Australia reserves the right, in its sole discretion, to disqualify, eject, or ban any Participant from KOTC Activities for: 

  • Breach of these Terms or event rules. 

  • Unsportsmanlike or dangerous conduct. 

  • Violation of the Code of Conduct. 

  • Any other reason deemed necessary for the safety and integrity of KOTC Activities. 

No refunds will be provided in such cases. 

9.7 Photography and Media Release 

By participating in KOTC Activities, you acknowledge and agree that: 

  • Photographs, videos, and recordings may be taken during events. 

  • King of the Court Australia and Bill Lang International may use your name, image, likeness, and voice in promotional materials, social media, websites, and other media without compensation or further consent. 

If you do not wish to be photographed or recorded, you must notify event organisers in writing before the event. 

 

10. PAYMENT, REFUNDS, AND CANCELLATIONS 

10.1 Payment 

Registration fees and any other charges for KOTC Activities must be paid in full at the time of registration unless otherwise specified. Payment must be made through the payment methods provided on the Website. 

10.2 Refunds 

Refunds are subject to the following policy: 

  • Cancellation by Participant (More than 14 days before event): Full refund minus a 10% administrative fee. 

  • Cancellation by Participant (7-14 days before event): 50% refund. 

  • Cancellation by Participant (Less than 7 days before event): No refund. 

  • Cancellation or Postponement by KOTC: Full refund or credit towards a future event. 

Refunds will be processed within 14 business days of approval. 

10.3 Non-Transferability 

Registration for KOTC Activities is non-transferable unless approved in writing by King of the Court Australia. 

10.4 Australian Consumer Law – Consumer Guarantees 

Nothing in this section limits or excludes your rights under the Australian Consumer Law for refunds, repairs, or replacements where goods or services are faulty, not fit for purpose, or do not match their description. 

 

11. PRIVACY AND DATA PROTECTION 

Your use of the Website and participation in KOTC Activities are subject to our Privacy Policy, which is incorporated into these Terms by reference. 

We collect, use, and store your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. For full details, please refer to our Privacy Policy available at [insert link]. 

By using the Website or participating in KOTC Activities, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy. 

 

12. CONSENT MECHANISMS 

12.1 Consent to Terms 

By ticking the checkbox at registration, clicking "I Agree," or otherwise accessing or using the Website or participating in KOTC Activities, you expressly consent to be bound by these Terms. 

12.2 Consent to Waiver and Release 

You acknowledge that you have read, understood, and voluntarily agree to the waiver and release provisions contained in Section 6 of these Terms. 

12.3 Consent for Minors 

If you are under 18 years of age, a parent or legal guardian must review, agree to, and sign these Terms on your behalf before you may participate in KOTC Activities. The parent or guardian assumes all responsibilities and liabilities under these Terms on behalf of the minor. 

 

13. DISPUTE RESOLUTION AND GOVERNING LAW 

13.1 Governing Law 

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. 

13.2 Jurisdiction 

You irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia, and any courts that may hear appeals from those courts, for the resolution of any disputes arising out of or relating to these Terms, the Website, or KOTC Activities. 

13.3 Dispute Resolution Process 

Before commencing legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiation. 

If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation administered by a recognised mediation service in Victoria. 

If mediation is unsuccessful, either party may commence legal proceedings. 

13.4 Class Action Waiver 

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. 

 

14. AMENDMENTS AND UPDATES 

King of the Court Australia reserves the right to modify, amend, or update these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Website. 

Your continued use of the Website or participation in KOTC Activities after changes are posted constitutes your acceptance of the updated Terms. 

It is your responsibility to review these Terms periodically. If you do not agree to any changes, you must cease using the Website and not participate in KOTC Activities. 

The date of the most recent update will be indicated at the top of these Terms. 

 

15. SEVERABILITY 

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect. 

 

16. ENTIRE AGREEMENT 

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and King of the Court Australia regarding your use of the Website and participation in KOTC Activities, and supersede all prior or contemporaneous agreements, understandings, representations, and warranties. 

 

17. WAIVER 

No waiver by King of the Court Australia of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

King of the Court Australia is committed to compliance with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth). 

We provide consumer guarantees where applicable, including guarantees that services will be provided with due care and skill, are fit for purpose, and delivered within a reasonable time, except where lawfully excluded for recreational services. 

19.2 Victorian Consumer Law Compliance 

King of the Court Australia complies with the Australian Consumer Law and Fair Trading Act 2012 (Vic) and all applicable Victorian consumer protection laws. 

19.3 Privacy Act Compliance 

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in the collection, use, storage, and disclosure of personal information. 

19.4 Fair Trading Compliance 

We are committed to fair trading practices and do not engage in misleading or deceptive conduct. 

19.5 Recreational Services Compliance 

KOTC Activities are recreational services under Section 139A of the Competition and Consumer Act 2010 (Cth). We have provided clear risk warnings and obtained your consent to exclude certain consumer guarantees as permitted by law. 

 

20. ACKNOWLEDGMENT 

By using the Website or participating in KOTC Activities, you acknowledge that: 

  • You have read and understood these Terms in full. 

  • You have had the opportunity to seek independent legal advice. 

  • You voluntarily agree to be bound by these Terms. 

  • You understand the risks associated with participation in KOTC Activities and voluntarily assume those risks.

4.3 KOTC Clubhouse Members (Additional Data):

  • Membership and Account Information: Username, password, membership tier (Free or VIP), member ID number, account preferences, communication preferences, security questions, membership history
